Product and manufacturer

Isotretinoin, sold in the United States under the brand name Accutane, is a retinoid — a derivative of vitamin A — used to treat severe nodulocystic acne and certain rare genetic skin disorders such as harlequin ichthyosis. It was developed by Hoffmann-La Roche, whose researchers in the 1960s identified 13-cis-retinoic acid as a candidate acne treatment; after an early pause over teratogenicity findings, the drug was studied in a collaboration with the National Cancer Institute and received FDA approval in 1982. Because isotretinoin is a potent teratogen, U.S. prescribing has been tightly controlled: a boxed warning has appeared on the label since 2005, and since March 2006 the drug has been dispensed only through the FDA-directed iPLEDGE risk-management program. Roche's patent expired in 2002, opening the market to generics, and in June 2009 Roche discontinued the Accutane brand in the United States, while overseas affiliates continued to market isotretinoin under other brand names.

Alleged harm

The litigation centered on two families of claims beyond the drug's known, expected side effects. First, a group of plaintiffs alleged that Accutane caused inflammatory bowel disease — particularly ulcerative colitis — and related intestinal injury, despite the label not warning of such a risk. Second, other plaintiffs alleged that the drug caused severe depression, psychiatric disturbances, and in some cases suicide, claims that drew congressional attention in the early 2000s and a European regulator's review of the neuropsychiatric risk. Additional claims raised liver injury, persistent dry eye, and other adverse effects. Whether isotretinoin causes these conditions remains scientifically contested, which is why the causation disputes in the cases turned heavily on epidemiology and individual medical histories.

Course of the litigation

State and federal cases filed by patients across the country were centralized in an MDL in New Jersey state court, styled In re Accutane Litigation, where consolidated pretrial proceedings addressed the common causation and warning questions.
