In re Prempro Products Liability Litigation

Prempro — marketed in some regions under the brand name Premphase — was a combined menopausal hormone therapy product made by the pharmaceutical company Wyeth, which was later absorbed into Pfizer. The drug paired two active ingredients: conjugated estrogens, an estrogen derived from horse urine and also sold under the brand name Premarin, and medroxyprogesterone acetate, a synthetic progestogen sold under the name Provera. The combination was prescribed to postmenopausal women to relieve menopausal symptoms, and it became one of the most widely used hormone therapies in the United States; as late as 2018 it still ranked among the country's most frequently prescribed medications.

The harm and its discovery

The scientific basis for the litigation came from the Women's Health Initiative (WHI), a large prospective study of postmenopausal women. The study reported that combined estrogen-plus-progestogen therapy was associated with increased risks of breast cancer, coronary heart disease, stroke, and blood clots. When the results became public, prescribing practice changed quickly, and thousands of women who had taken Prempro brought product liability claims. The suits alleged that the drug had caused breast cancer and, in some cases, death, and they also challenged how the product had been labeled and promoted. Litigation further exposed the promotional literature surrounding the drug: Wyeth had engaged a medical ghostwriting firm to produce favorable studies, and academics were asked to lend their names to company-prepared papers. The effort produced numerous peer-reviewed journal articles on hormone replacement therapy that portrayed the combination therapy favorably, and those materials became a subject of scrutiny in the case.

The MDL: No. 1507, Eastern District of Arkansas

The individual Prempro actions were filed in a number of federal and state courts. On March 4, 2003, the Judicial Panel on Multidistrict Litigation centralized the cases in the United States District Court for the Eastern District of Arkansas (Little Rock), docketed them as MDL No. 1507 under master file 4:03-cv-01507, and assigned the consolidated actions to Judge William R. Wilson Jr.

In the consolidated docket, common issues — including the drug's labeling, the WHI findings, and the promotional practices described above — were addressed through coordinated discovery, while individual claims, including breast cancer and death claims, were to be resolved within the MDL's settlement structure rather than through a sequence of separate trials.

Outcome

The litigation was resolved in 2012 through settlements. The parties reached a settlement, and a JPML order dated August 3, 2012 reflects the final phase of case-by-case settlements in the docket. The MDL's status is recorded as terminated, and no verdict outcomes are reflected in the primary sources for this case.
